This can include items such as your name, address, phone number, identification numbers (such as an account number or your government identification number), location data or online identifiers. Personal information can be held electronically or in certain paper records.

Who we are

Christie^® Digital Systems Canada Inc. (“Christie”, “we”, “us” or “our”) with an address at 809 Wellington Street North, Kitchener, Ontario N2G 4Y7 Canada, is part of the Christie Digital group of companies, whose ultimate parent company is Ushio, Inc. For the purposes of the EU General Data Protection Regulation (the “GDPR”), Christie is the data controller. This means we are responsible for deciding how we use the personal information we hold.

What information do we collect?

We may collect and process the following personal information about you:

Information you provide to us when you:

• register on our Sites,
• subscribe to our newsletter,
• respond to a survey,
• fill out an online form,
• download software drivers or applications,
• report any problem or complaint with our Sites, products and services,
• give us your business card or contact information at a trade show or other event, or
• correspond with us by phone, email or otherwise.

This personal information may include contact information such as your name, e-mail address, mailing address or phone number as well as any interests or opinions that you share with us. You may, however, visit our Sites anonymously.

Information we collect about you:

Our web servers may collect technical information including the IP address of visitors to our Sites, browser type and version, time zone setting, browser plug-in types and versions, operating system and platform.

We also collect information on what you view, click on and access in and through our marketing emails and text messages. This may include the geographic location of the device you have used.

We may collect voice recordings of your communications with us for quality control, training, security and regulatory purposes, but may also capture your location, i.e. use of home landline number.

If you contact us via social media, we may collect details from your social media account.

If you download and use one of our software services or applications and choose to participate in our user experience improvement program, we may collect information that relates to Christie products and services, such as product usage and diagnostic information (without identifying you personally).

What do we use your information for?

We use your personal information as described in this privacy policy and primarily to respond to your queries, provide services that you have requested or to perform our responsibilities under any contract with you.

In some cases, we will process your personal information on the basis of your informed consent which you can withdraw at any time, or to pursue our legitimate interests except where such interests are overridden by your rights and interests. We may also process your personal information where we are required by law to do so.

We will process personal information for the following purposes:

• to personalize your experience (your personal information helps us to better respond to your individual needs),
• to improve our Sites and our products and services (we continually strive to improve our Sites and offerings based on the information and feedback we receive from you, your online behaviour and your participation in our user experience improvement program,
• to improve customer service (your information helps us to more effectively respond to your sales inquiries, customer service requests and support needs),
• to administer a contest, promotion, survey or other Site feature,
• to send periodic emails, where you have given your consent,
• to transfer your personal information as part of a merger or sale of our business, and
• for other purposes disclosed to you at the time you provide your personal information.

The email address you provide in connection with any website or offline inquiry will only be used to send you information and updates pertaining to your inquiry. If you decide to opt-in to our mailing list, including in person during a trade show or other event, you will receive emails that may include company news, updates, related product or service information, etc.

If at any time you would like to unsubscribe from our marketing email list, we include detailed unsubscribe instructions at the bottom of each email.

How do we protect your information?

We implement a variety of security measures to maintain the safety of your personal information when you access your personal information.

Do we use cookies?

Like many websites, our Sites use cookies to distinguish you from other users of the Sites. This helps us to analyze the use of our Sites to customize and improve the content and the layout of our Sites.

A cookie is a small file of letters and numbers that is stored on your browser or the hard drive of your computer, if your browser settings permit. Cookies contain information that is transferred to your computer's hard drive.

Do we disclose any information to outside parties?

Except as otherwise provided in the “Your California Rights” below, we do not sell, trade, or otherwise transfer personal information to outside parties. This does not include trusted third parties who assist us in operating our website, conducting our business, or servicing you, so long as those parties agree to keep this information confidential and agree to strict contractual protections, where required.

We may also release your information when we believe release is appropriate to comply with the law, enforce our site policies, or protect ours or others rights, property, or safety. However, non-personally identifiable visitor information may be provided to other parties for marketing advertising, or other uses.

How long we store your personal information

We will store your personal information, in a form which permits us to identify you, for no longer than is necessary for the purpose for which the personal information is processed. We may retain and use your personal information as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements and rights, or if it is not technically reasonably feasible to remove it. Consistent with these requirements, we will try to delete your personal information quickly upon request.

“Do not track” signals

We do not respond to web browser “do not track” signals. As such, your navigation of our Site may be tracked as part of the gathering of quantitative user information described above. If you arrive at our Site by way of a link from a third party site that does respond to “do not track” requests, the recognition of any “do not track” request you have initiated will end as soon as you reach our Site.

Third party links

Occasionally, at our discretion, we may include or offer third party products or services on our website. These third party sites have separate and independent privacy policies. We therefore have no responsibility or liability for the content and activities of these linked sites. Nonetheless, we seek to protect the integrity of our site and welcome any feedback about these sites.

Your Californian Rights

For residents of California only. Because we value your privacy we have taken the necessary precautions to be in compliance with the California Online Privacy Protection Act, the California Shine the Light Act and the California Consumer Privacy Act.

Your California Privacy Rights (Shine the Light Act)

We will not distribute your personal information to outside parties without your consent, other than to direct any sales inquiries to our authorized dealers and integrators who may respond to such inquiries on our behalf.

California Consumer Privacy Act Rights

As of January 1, 2020, under the California Consumer Privacy Act (“CCPA”), verified California residents will have the right to:

• Request and receive disclosure of our personal information collection practices during the prior 12 months, including the categories of personal information we collect, the categories of sources of such information, our business purpose for collecting or sharing such information, and the categories of third parties with whom we share such information;
• Request and receive a copy of the personal information we have collected about them during the prior 12 months;
• Request and receive disclosure of our information sharing practices during the prior 12 months, including a list of the categories of personal information sold with the category of third party recipients and a list of the categories of personal information that we disclosed for a business purpose;
• Request that we not sell personal information about them; and
• Request that we delete (and direct our service providers to delete) their personal information subject to certain exceptions. 

For purposes of the CCPA personal information means information that identifies, relates to, describes, is capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular California resident or household.

We may request that you submit a signed statement under penalty of perjury that you are the individual you claim to be.  We will acknowledge receipt of your request within 10 days and will endeavor to respond within forty-five days of receipt of your request, but if we require more time (up to an additional forty-five days) we will notify you of our need for additional time. For requests that we not sell your information we will comply with your request within 15 days.  We cannot respond to your request or provide you with personal information if we cannot verify your identity and confirm that the personal information relates to you.

You may make a request for disclosure of our information collection practices, the information we collected about you, or our sharing practices up to twice within a 12-month period.  You may make a request that we not sell information or for deletion of your information at any time.

For requests for a copy of the personal information we have collected during the 12 months prior to your request we will endeavor to provide the information in a format that is readily useable, including by mailing you a paper copy or providing an electronic copy to your registered account, if you have registered an account with us.

For requests for deletion of your information please understand that California law permits us to retain certain information and not to delete it under certain circumstances.  By way of example, we are not required to comply with a request to delete information if the information is necessary for us to complete a transaction for you or otherwise perform a contract; to detect, protect against, or prosecute security incidents, fraud or illegal activity; to use the information only internally in ways reasonably aligned with your expectations as our customer (such as maintaining sales records), and to comply with legal obligations. If we receive such a request from you we will ask you to separately confirm your request and will notify any service providers we have engaged to delete your information as well.

We will not discriminate against you as a result of your exercise of any of these rights. 

We do not sell you information for monetary consideration but we may transfer your information to a third party that provides us with services such as helping us with advertising, data analysis and security, which may fall under the definition of for “other valuable consideration” which may be considered a ‘sale’ under the CCPA. During the past 12 months we disclosed Identifiers and Commercial Information with third parties for a business purpose which may fall within the definition of a ‘sale’.  If you are over the age of 16 and would like to instruct us not to sell your personal information, please visit our Do-Not-Sell web page https://info.christiedigital.com/ccpa-do-not-sell-page.

We do not sell personal information of individuals we actually know are less than 16 years of age. Once we receive your Do-Not-Sell request we will wait at least 12 months before asking you to reauthorize personal information sales.

Using an Authorized Agent.  You may submit a request through someone holding a formal Power of Attorney.  Otherwise, you may submit a request using an authorized agent only if (1) you provide the authorized agent with written permission to make a request and (2) you verify your own identity directly with us.  We will require the agent to submit proof to us that they have been authorized to make requests on your behalf.

During the past 12 months, we have collected the following categories of information from the listed sources, used it for the listed business purposes and shared it with the listed categories of third parties.  The categories of information include information we collect from our website visitors, registered users, employees, vendors, suppliers and any other person that interacts with us either online or offline. Not all information is collected about all individuals.  For instance, we may collect different information from applicants for employment or from vendors or from customers.

• For marketing and promotions we believe you may find of interest and to provide you, or allow selected third parties to provide you, with information about products and services that may interest you;

3. Auditing relating to transactions, internal research and development.

• To provide for internal business administration and operations, including troubleshooting, Site customization, enhancement or development, testing, research, administration and operation of our Sites and data analytics;
• To create products or services that may meet your needs;
• To measure performance of marketing initiatives, ads, and websites “powered by” another company on our behalf;

4. Security detection, protection and enforcement; functionality debugging, error repair.

• As part of our efforts to keep our Sites safe and secure;
• To ensure the security of your account and our business, preventing or detecting fraud, malicious activity or abuses of our Sites, for example, by requesting verification information in order to reset your account password (if applicable);

5. Quality control.

• To monitor quality control and ensure compliance with our legal obligations, codes and ordinances, policies and procedures,
• To develop and improve our products and services, for example, by reviewing visits to the Sites and various subpages, demand for specific products and services and user comments;

Your European Rights

For residents of the European Union only. You have the right to ask us not to process your personal information for marketing purposes. You can exercise the right by contacting us as described below.

Under European data protection law, in certain circumstances, you have the right to:

• request access to your personal information,
• request correction of your personal information,
• request erasure of your personal information,

In addition, where you believe that we have not complied with our obligations under this privacy policy or European law, you have the right to make a complaint to a European Data Protection Authority, such as the UK Information Commissioner’s Office.

Where we store your personal information

The Sites are published in Canada and are subject to the laws of the Province of Ontario, Canada. If you are located in a country outside of Canada, including the European Union, and submit personal information to us, you consent to the general use of such information as provided in this privacy policy and to the transfer of that information to, and storage of that information in, Canada.

Children’s Online Privacy Protection Act Compliance

We are in compliance with the requirements of COPPA (Children’s Online Privacy Protection Act), we do not collect or accept any information from individuals that we know to be under 13 years of age. Our website, products and services are all directed to people who are at least 13 years old or older.

Changes to our Privacy Policy

If we make any material changes to this privacy policy or the way we use, share or collect personal information, we will notify you by revising the “Last Updated” date at the top of this privacy policy, prominently posting an announcement of the changes on our Site, or sending an email to the email address you most recently provided us (unless we do not have such an email address) prior to the new policy taking effect.

Contacting Us

To exercise any of your rights under this Privacy Policy or European law, you may contact us via the Data Subject Request Form.  We will ask you for information that allows us to reasonably verify your identity (that you are the person about whom we collected personal information or an authorized representative thereof) and will use that information only for that purpose. We may request that you submit a signed statement under penalty of perjury that you are the individual you claim to be and in cases of a representative making a request on behalf of a third party, we will contaqct the data subject to confirm the representative is authorized to make such a request.  In any event, we will acknowledge receipt of your request within 10 days and will endeavor to respond within forty-five days of receipt of your request, or if we require more time we will notify you of our need for additional time within forty-five days of your request. We cannot respond to your request if we cannot verify your identity and confirm that the personal information relates to you or you are otherwise an authorized representative of the individual to whom the personal information relates.
